METROLOGIC SERVICE PLAN – SILVER (2 years)
Metrologic warrants and represents that the products covered hereunder (“Products”) are free of all defects in material, workmanship and design, and have been produced and labeled in compliance with all applicable U.S. Federal, state and local laws, regulations and ordinances pertaining to their production and labeling.
This service plan is limited to repair, replacement of Product or refund of purchase price at the sole discretion of Metrologic. Faulty equipment must be returned to one of the following Metrologic repair facilities: Blackwood, New Jersey, U.S.A; Madrid, Spain; or Suzhou, China. To do this, contact Metrologic’s Customer Service/Repair Department to obtain a Returned Material Authorization (RMA) number. In the event Metrologic determines to replace a Product with a functionally equivalent unit, it may send the new or refurbished Product within ten (10) business days of receipt by Metrologic of the faulty unit. Repaired and replaced units shall be shipped at Metrologic’s expense without charge for service or return freight. The amount of any refund made by Metrologic will be equal to the original purchase price, including the price paid for any service plan coverage.
This service plan applies to new products only, excluding accessories, and does not extend to any Product which, in the sole judgment of Metrologic, has been subjected to abuse, misuse, neglect, improper hardware or software installation or configuration, improper handling or storage, or accident, or any damage due to (a) use or misuse produced from integration of the Product into any mechanical, electrical or computer system; (b) a failure to follow instructions contained in the Product manual or other documentation provided with the Product; or (c) water or other liquids, where such damage is tantamount to abuse, in Metrologic’s sole judgment. The service plan is void if (i) the case of the Product is opened by anyone other than Metrologic’s repair department or authorized repair centers; or (ii) any software is installed on the Product other than a software program approved by Metrologic; or (iii) the Product is modified or disassembled by anyone other than Metrologic’s repair department or authorized repair centers; or (iv) if the serial number of the Product is unintelligible. In all cases, Metrologic has the right to test and inspect the faulty Product and if in the sole judgment of Metrologic the faulty Product is found not to be covered under this service plan, Metrologic will invoice accordingly.
This service plan will commence upon the date of purchase of the unit and terminate two years from the date thereof. After termination of this service plan, any standard warranty remaining on the Product will apply.

IN NO EVENT SHALL METROLOGIC BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES, INCIDENTAL DAMAGES, DAMAGES TO PERSON OR PROPERTY, OR EFFECT ON BUSINESS OR PROPERTY, OR OTHER DAMAGES OR EXPENSES DUE DIRECTLY OR INDIRECTLY TO THE PRODUCT, EXCEPT AS STATED IN THIS SERVICE PLAN. IN NO EVENT SHALL ANY LIABILITY OF METROLOGIC EXCEED THE ACTUAL AMOUNT PAID TO METROLOGIC FOR THE PRODUCT. METROLOGIC RESERVES THE RIGHT TO MAKE ANY CHANGES TO THE PRODUCT AT ANY TIME.
EXCEPT AS OTHERWISE STATED HEREIN, THIS SERVICE PLAN IS NON-REFUNDABLE, IN WHOLE OR IN PART. THERE ARE NO EXCEPTIONS.

This service plan is limited to repair, replacement of Product or refund of purchase price at the sole discretion of Metrologic. Faulty equipment must be returned to one of the following Metrologic repair facilities: Blackwood, New Jersey, U.S.A; Madrid, Spain; or Suzhou, China. This service plan does provide coverage up to one incident per scanner annually from the date of purchase for repairs necessitated by normal wear and tear and accidents. The service plan is void if (i) the case of the Product is opened by anyone other than Metrologic’s repair department or authorized repair centers; or (ii) any software is installed on the Product other than a software program approved by Metrologic; or (iii) the Product is modified or disassembled by anyone other than Metrologic’s repair department or authorized repair centers; or (iv) if the serial number of the Product is unintelligible. In all cases, Metrologic has the right to test and inspect the faulty Product and if in the sole judgment of Metrologic the faulty Product is found not to be covered under this service plan, Metrologic will invoice accordingly.

Repaired and replaced units shall be shipped at Metrologic’s expense without charge for service or return freight. The amount of any refund made by Metrologic will be equal to the original purchase price, including the price paid for any service plan coverage.
This service plan applies to new products only, excluding accessories, and does not extend to any Product which, in the sole judgment of Metrologic, has been subjected to abuse, misuse, neglect, improper hardware or software installation or configuration, improper handling or storage, damage caused by natural or man-made disasters, or any damage due to (a) use or misuse produced from integration of the Product into any mechanical, electrical or computer system; (b) a failure to follow instructions contained in the Product manual or other documentation provided with the Product; or (c) water or other liquids, where such damage is tantamount to abuse, in Metrologic’s sole judgment. This service plan does provide coverage up to one incident per scanner annually from the date of purchase for repairs necessitated by normal wear and tear and accidents. The service plan is void if (i) the case of the Product is opened by anyone other than Metrologic’s repair department or authorized repair centers; or (ii) any software is installed on the Product other than a software program approved by Metrologic; or (iii) the Product is modified or disassembled by anyone other than Metrologic’s repair department or authorized repair centers; or (iv) if the serial number of the Product is unintelligible. In all cases, Metrologic has the right to test and inspect the faulty Product and if in the sole judgment of Metrologic the faulty Product is found not to be covered under this service plan, Metrologic will invoice accordingly.
This service plan will commence upon the date of purchase of the unit and terminate five years from the date thereof. After termination of this service plan, any standard warranty remaining on the Product will apply.
THE SERVICE PLAN SET FORTH HEREIN, EXCEPT AS TO TITLE, IS IN LIEU OF ALL OTHER WARRANTIES OR GUARANTEES, EITHER EXPRESS OR IMPLIED, AND SPECIFICALLY EXCLUDES, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE UNDER THE UNIFORM COMMERCIAL CODE, OR ARISING OUT OF CUSTOM OR CONDUCT. THE RIGHTS AND REMEDIES PROVIDED HEREIN ARE EXCLUSIVE AND IN LIEU OF ANY OTHER RIGHTS OR REMEDIES. IN NO EVENT SHALL METROLOGIC BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES, INCIDENTAL DAMAGES, DAMAGES TO PERSON OR PROPERTY, OR EFFECT ON BUSINESS OR PROPERTY, OR OTHER DAMAGES OR EXPENSES DUE DIRECTLY OR INDIRECTLY TO THE PRODUCT, EXCEPT AS STATED IN THIS SERVICE PLAN. IN NO EVENT SHALL ANY LIABILITY OF METROLOGIC EXCEED THE ACTUAL AMOUNT PAID TO METROLOGIC FOR THE PRODUCT. METROLOGIC RESERVES THE RIGHT TO MAKE ANY CHANGES TO THE PRODUCT AT ANY TIME.
EXCEPT AS OTHERWISE STATED HEREIN, THIS SERVICE PLAN IS NON-REFUNDABLE, IN WHOLE OR IN PART. THERE ARE NO EXCEPTIONS. |
